What contract-to-permanent means

Under a contract-to-permanent model, the candidate starts as a contractor (or fixed-term employee through a staffing partner). They work under your direction on real tasks. After an agreed period — commonly three to six months, sometimes longer for complex programmes — you decide whether to convert them to a permanent role.

This is different from a pure permanent search (hire immediately as an employee) and different from pure contract staffing (no conversion path). The conversion path should be written into the commercial agreement so fees, notice, and timing are clear for you, the candidate, and the agency.

You evaluate delivery on the job, not only in interviews. Whiteboard tests and CV screens matter, but they do not replace seeing how someone handles your codebase, stakeholders, and sprint rhythm.

  • Cloud, data, or cybersecurity programmes with a defined delivery phase that may become a standing function
  • Roles where soft skills and stakeholder management matter as much as the tech stack
  • Foreign companies testing Malaysia capacity before locking permanent headcount (sometimes alongside EOR)

A practical conversion path

Agree the model before day one. Ambiguity creates candidate anxiety and commercial disputes later.

  • Define the contract period and the earliest conversion review date
  • Set success criteria: delivery outcomes, behaviours, and any must-have certifications
  • Confirm who employs the person during the contract phase (your company or the staffing partner)
  • Document conversion fees, if any, and how they relate to permanent placement terms
  • Plan knowledge transfer and access so conversion does not reset onboarding from zero
  • Be transparent with the candidate that conversion is performance-based, not automatic

Commercial models (what to ask your agency)

Agencies structure contract-to-perm differently. Ask for the model in writing:

During the contract phase

  • Cost-plus or markup on monthly contractor cost, including statutory contributions if the agency is the employer
  • Replacement terms if the contractor exits early (for example a 45-day replacement window)
  • Who owns equipment, IP assignment, and confidentiality

At conversion to permanent

  • Whether a permanent placement fee applies, and if contract fees already paid are credited
  • Notice period from contract end to permanent start
  • What happens if you do not convert — continue on contract, or close the engagement

Candidate benefits (why good people accept it)

Strong candidates often prefer a clear conversion path over an open-ended contract with no future. They get time to assess your culture and stack; you get time to assess their delivery. Position conversion criteria honestly — overselling “guaranteed permanent” damages trust if the role does not materialise.
